The Senate of the Parliament of the Republic of Kazakhstan at the plenary session ratified the Agreement on mutual legal assistance on administrativei in the sphere of personal data exchange, Kazpravda.kz correspondent reports.
As noted earlier, the development of this agreement is due to the need to create a legal framework for the exchange of such information between the competent authorities of the CIS states. The agreement was signed on December 18, 2020 at a meeting of the Council of Heads of State.
Ratification of the agreement will allow receiving information from the Commonwealth countries about the presence, absence of citizenship; issued identity documents of persons registered with migration; visas issued to foreigners for entry and stay in these countries; real estate or liabilities of a property nature; bringing to criminal or administrative responsibility.
The information will be requested by authorized bodies through sending requests. This is especially topical for the exclusion of dual citizenship.
In addition, the agreement creates additional conditions for confirming the identity of a person in case of loss of identity documents obtained in another country; establishing a person's place of residence abroad. Information about holding persons accountable for committing an administrative or criminal offense can be used as part of the provision of legal assistance. At the same time, the agreement defines the terms of confidentiality and restrictions on the use of information, as well as the grounds for refusing to provide information.
The ratification of the agreement will improve the efficiency of interaction between the competent authorities of the CIS countries. The draft law on the ratification of the agreement has been agreed with all interested government agencies, and its adoption will not entail negative socio-economic and legal consequences, and will not require additional financial costs.
